We want you to feel secure and at ease as you collaborate successfully with Festo. We also want to meet your needs and be a reliable partner when it comes to protecting your personal data.

The subject of data protection is personal data. This is any information relating to an identified or identifiable natural person (data subject).

As a global leader in automation technology and in technical education and training, we process personal data on a daily basis. In doing so, we are committed to complying with national and international laws and regulations on data protection, in particular the European General Data Protection Regulation (GDPR).

Where the masculine form is used here, this is merely for linguistic simplification. Statements refer equally to all genders.

2. What sources and data do we use?

General

We process personal data that we receive in the course of our business activities. In addition, to the extent necessary for the provision of our services, we process personal data that we permissibly obtain from publicly accessible sources (for example, debt collection registers, land registers, commercial registers, the press, the Internet) or that we are legitimately provided with.

We only use other personal data if you provide us with this data, among other things, as part of a contact form, a survey, a registration for an event, a competition, a registration or for the performance of a contract, and even in these cases only to the extent that we are permitted to do so under the applicable legal provisions.

Personal data is individual information about personal or factual circumstances of a specific or identifiable natural person (data subject). It does not matter whether identification is possible directly or indirectly.

For example, we collect the following data:

o Personal data (name, address, e-mail address, telephone number and other contact data, gender, marital status, date and place of birth, nationality).

o Legitimation data (e.g. ID card data) o Authentication data (e.g. specimen signature)

o Tax data (e.g. tax ID)

o Order data

o Data resulting from the fulfillment of our contractual obligations

o Advertising and sales data (including advertising scores), documentation data

o Data in the context of business initiation and during the ongoing business relationship, recording of telephone calls as well as the result of the communication

o In addition to the personal data listed, further personal data may be processed in each case when products/services are concluded and used.

Newsletters and events

In the context of sending newsletters, personal data (such as e-mail address or password) are processed by us. Furthermore, the click behavior in the newsletter is tracked. We use this information to be able to send content that is better tailored to your interests.

By subscribing to the newsletter, you fully consent to this processing. You have the option to unsubscribe from the newsletter in each newsletter.

By registering for an event, you expressly agree that we will only use your data for registration and automated processing of the event and, if necessary, forward it to our subcontractors for this purpose.

Internet pages

Each time you call up one of our Internet pages, our system collects a series of general data and information.

This includes, for example, the following data:

o Information about the type of browser and the version used.

o The operating system of the user

o The user's Internet service provider

o The IP address of the user

o Date and time of access

o Websites from which the user's system accesses our website

o Websites that are accessed by the user's system via our website

Log files

IP addresses or other data that allow an assignment to a user are stored in the log files. This data is not stored together with other personal data of the user.

The storage of the IP address by the system is absolutely necessary to enable the delivery and functionality of the website to the user's computer. In addition, the data is used to optimize the website and to ensure the security of our information technology systems (purpose of data processing).

These purposes in the sense of the DSG represent the legitimate interest and justification of Festo AG in data processing.

Cookies

Furthermore, various cookies may also be used on your technical end devices, which also access so-called IT data, i.e. IP address(es) and various assignment features of your devices.

3. For what purpose do we process your data and on what legal basis?

As a company based in Switzerland, we process personal data in accordance with the provisions of the Data Protection Act (DPA) and other relevant national regulations such as the Telecommunications Act (TCA). - For the fulfillment of contractual obligations (Art. 13 para. 2 lit. a DSG). Data is processed for performance in the context of the execution of our contracts, pre-contractual measures and training activities, which are carried out upon request. Please refer to the relevant communication materials, contractual documents and terms and conditions of the respective areas and activities for further details on the data processing purposes.

- Within the framework of the balancing of interests (Art. 13 Para. 1 DSG). Where necessary, we process your data beyond the actual fulfillment of the purpose in order to protect further legitimate interests of us or third parties.

Examples:

o Assertion of legal claims and defense in legal disputes.

o Ensuring the IT security and IT operation of Festo AG.

o Prevention and investigation of criminal offences

o Video surveillance to safeguard the right of access to the premises, for the collection of evidence in the event of robberies and fraud offences

o Measures for building and facility security (e.g. access controls), measures to ensure the right of access to the premises

o Measures for business management and further development of services and products

o Measures for advising and supporting our customers

o Examination and optimization of procedures for demand analysis for the purpose of direct customer contact

o Advertising or market and opinion research, provided you have not objected to the use of your data.

Insofar as you have given us consent to process personal data for specific purposes, the lawfulness of this processing is based on your consent.

Consent given can be revoked at any time. The revocation of consent does not affect the lawfulness of the data processed until the revocation.

5. How do we ensure the security of your data?

Festo AG uses technical and organizational security measures to protect the data we manage from accidental or intentional manipulation, loss, destruction or access by unauthorized persons. Our security measures are continuously improved in line with technological developments.

Web tools include, but are not limited to, tracking, web analytics, and social media.

7. Does profiling take place?

We sometimes process your data automatically with the aim of evaluating certain personal aspects (so-called profiling). In order to be able to inform and advise you in a targeted manner about products, services and other activities, we use evaluation tools that enable needs-based communication and advertising, including market and opinion research.

We use the following instruments for this purpose, for example: - Scoring is based on a mathematically-statistically recognized and proven procedure. The calculated score values support us in decision-making, e.g. in the context of product sales, visits to trade fairs and completed training courses.

- In addition, we sometimes also use the (automated) merging of several data from different sources into one profile with the purpose of analyzing personal interests and behavior in order to improve customer dialog. In any case, we only do this with consent. Consent can be revoked at any time.

8. How does your consent occur when visiting our internet pages?

By using our Internet pages, you agree to our general guidelines on data protection and consent to the use of your data described under this statement.

We take the liberty of adapting and supplementing the data protection declaration. The currently published privacy policy applies in each case.
