Policy relating to Products or Materials Return

1. Festo Private Limited ("FESTO") has permitted the return of certain products or materials which the Customer had purchased from FESTO (the "Goods"). In consideration, the Customer agrees to be bound by the terms and conditions set out in this policy.

2. The Customer hereby represents and undertakes to FESTO that:

2.1 the Goods are new and previously unused and are not obsolete;

2.2 Unless the express consent of FESTO has been obtained, none of the Goods are non-stockable Goods. Non-stockable Goods are Goods that have been customized or configured by FESTO at the request of the Customers and/or are Goods that are not active or locally stored items;

2.3 the Goods are in re-saleable condition and will be provided with proper packaging, label and relevant documentation (where applicable);

2.4 the Goods return request shall be no later than 30 days from the date of delivery;

2.5 the minimum value for any Goods returned shall be SGD150, based on prices stated in the invoice relating to the Goods to be returned.

3. The return of the Goods is subject at all times to FESTO's acceptance. For all Goods returned and accepted by Festo, Festo will refund the Customer by providing the Customer with credit, to be offset against future purchases by the Customer. The amount of credit the Customer is entitled to will be based upon (i) price of the Goods in effect at the time of return of Goods; or (ii) the time of invoicing, whichever is lower (the "Goods Value") after deducting any applicable charges as. In no circumstances shall FESTO be liable to refund the Customer cash for any returned Goods.

4. In accepting returned Goods, FESTO shall be entitled to impose a minimum charge of 15.0% of the Goods Value to cover expenses in relation to handling, re-inspection and any additional expenses incurred in restoring the Goods to saleable condition, without the prior consent of the Customer, which shall be offset against the credit to be granted to the Customer.

5. The Customer shall be responsible for all cost relating to the return of the Goods to FESTO.

6. FESTO has the right to reject return Goods if such Goods do not comply with the warranties set out in this Policy. In such an event, the Customer shall be responsible for all costs relating to the return of such rejected Goods by FESTO to the Customer.

7. In the event of a conflict between the terms of this Policy and the FESTO Standard Terms and Conditions of Sales, the terms of this Policy will prevail.

8. These terms and conditions are governed by Singapore law. Any dispute arising out of or in connection with these terms and conditions, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by the courts of Singapore. The foregoing shall, however, not prevent Festo from seeking temporary injunctive relief from any competent court.
